General Terms and Conditions of Sale

1. Preamble
These General Terms and Conditions of Sale (GTC) govern the sales of derivative products made via the website [www.comptoirs-lesdeuxmagots.fr] (hereinafter the "Site").
These contracts are concluded between a natural or legal person wishing to make a purchase for their strictly personal use, via the Site (hereinafter referred to as the "Customer") and SAS LDM DEVELOPPEMENT, whose full contact details are as follows:

2. Acceptance of conditions
Any order placed on the Site implies unreserved acceptance of these Terms and Conditions. The Customer acknowledges having full legal capacity, having read these Terms and Conditions and accepts them without restriction or reservation before validating their order.
3. Products
3-1 Marketing
LDM DÉVELOPPEMENT presents on the Site the various Products offered for sale, accompanied by detailed descriptions. This information allows the Customer to learn, before placing any final order, the essential characteristics of each Product available for purchase via the Site, in accordance with the provisions of Article L.111-1 of the French Consumer Code.
LDM DÉVELOPPEMENT strives to present the Products as accurately as possible. However, due to technical limitations related to image distribution over the Internet, variations may exist between the photographic representation displayed on the Website and the Product actually delivered. Photographs are not contractual.
The products offered for sale comply with current French regulations.
3-2 Availability
Products are offered for sale subject to availability at the time the order is placed by the Customer. Any product that becomes unavailable is indicated as such on the Website.
LDM DÉVELOPPEMENT implements all reasonable means to ensure the availability of all Products offered for sale.
LDM DÉVELOPPEMENT reserves the right, at any time, to modify the Product offerings or to discontinue the sale of certain Products listed on the Site. However, these modifications do not affect orders validly accepted before they take effect.
In the event of total or partial unavailability of a Product after validation of the order, LDM DÉVELOPPEMENT will inform the Customer as soon as possible by email and will proceed with the refund of the products which turn out to be unavailable.
3-3 Price
The applicable prices are those displayed on the Site at the time the Customer validates the order. They are indicated in euros (€), inclusive of all taxes (TTC), and include the French Value Added Tax (VAT) in effect on the date of the order.
The Customer is informed that delivery charges are not included in the price of the Products and are billed separately. Their amount is specified to the Customer before final order confirmation, in particular on the order summary and in the confirmation email.
LDM DÉVELOPPEMENT reserves the right to modify its prices at any time and without prior notice. However, Products are invoiced based on the rates in effect at the time the order is registered; price changes will not affect orders already accepted.
4. Ordering Process
4-1 Prerequisites
In order to place an order, the Customer must meet certain conditions:
• Have an address in one of the countries covered by our delivery zones
• Have a bank account with sufficient funds to pay for their order online
• To have the legal capacity to contract
• Must be of legal drinking age to order alcohol, in accordance with the provisions of Article L. 3342-1 of the Public Health Code
• When ordering a gift card, the Customer is invited to read and accept the dedicated terms and conditions of sale, which can be viewed here.
4-2 Ordering products
To add a Product to their cart, the Customer will click on the "Add to cart" icon.
A minimum of 25 euros including VAT per order (excluding shipping or delivery costs) is required to validate it.
At any time, the Customer may:
- to obtain a summary of the Products he has selected or to modify his basket, by clicking on the "Basket" icon accessible on each page
- validate your basket by clicking on "Proceed to payment" after having mandatoryly checked the box "I have read and I accept the General Terms and Conditions of Sale and Use".
Once the Customer clicks on "Proceed to payment", the Customer arrives at the payment page and agrees to provide the following information:
- their surname(s), first name(s), telephone number and email address. Said email address must be perfectly valid and in perfect working order.
- a postal address to which delivery can be made during business hours from Monday to Saturday.
The customer must also choose:
- The shipping method
- The chosen payment method
The information requested when placing the order is necessary for LDM DEVELOPPEMENT to be able to make the delivery.
The customer can choose to create an account or order without an account.
Once the information has been duly completed, the Customer clicks on the "Check order" button and arrives at the order summary page.
After reviewing the order summary, the Customer will be asked to:
-either click on the "Confirm payment" button to proceed with payment for their order; They can at any time click on one of the "Edit" buttons to modify the characteristics of their order and/or information relating to their personal details.
In order to pay, the Customer is invited to click on "Validate payment" and will be asked to proceed with the payment by entering their bank details.
The information and data recorded by LDM DÉVELOPPEMENT for the purposes of processing, invoicing and delivering orders constitute proof of the transactions that took place between LDM DÉVELOPPEMENT and the Client.
The order is firm and final only after its confirmation by LDM DEVELOPPEMENT, which is materialized by sending an email to the address provided by the Customer when placing their order.
In the event of a dispute or litigation relating to an order placed on the Site, the computer data kept by LDM DÉVELOPPEMENT, and in particular the records of orders, payments and electronic exchanges, shall be authentic between the Parties and shall be considered as having probative value, unless proven otherwise.
Order forms and invoices are archived by LDM DÉVELOPPEMENT on a reliable and durable medium, in accordance with applicable legal provisions. Invoices related to orders are made available to the Customer and remain accessible at any time in their personal account on the Website.
5. Payment
5-1 Payment Method
Payments are secure and can be made via bank cards, Visa, Mastercard, Paypal or Amex
5-2 Payment Security
Orders are paid for exclusively through secure payment methods offered on the Site via the Shopify platform, the technical provider of payment and hosting for the online store.
Bank transactions are processed by approved payment providers, in accordance with applicable security standards, including the PCI-DSS (Payment Card Industry Data Security Standard), guaranteeing the confidentiality and protection of payment data.
The data relating to the Client's means of payment are subject to secure encryption during transmission and are never stored, in plain text or in a usable form, by LDM DÉVELOPPEMENT, which at no time has access to the Client's bank details.
LDM DÉVELOPPEMENT cannot be held responsible for malfunctions attributable to payment providers or the Shopify platform, nor for consequences related to fraudulent use of payment methods resulting from a failure external to its system.
In the event of a bank refusal during the payment stage, the order is automatically cancelled and the Customer is notified on the email provided to LDM DEVELOPPEMENT when validating the order in question.
6. Order delivery and receipt
6-1 Delivery Zones
The Products ordered are delivered to the address provided by the Customer when placing their order and shown on the shipping label.
The Customer is solely responsible for the accuracy, completeness, and conformity of the information relating to the recipient's identity and address. This information must be sufficiently precise to allow for the routing and delivery of the Products under normal conditions. LDM DÉVELOPPEMENT shall not be held liable for any consequences resulting from errors, omissions, or incomplete information provided by the Customer.
The Products offered on the Site are delivered exclusively to the following geographical areas:
Metropolitan France (including Corsica), Monaco, and the following countries:
• Countries of the European Economic Area:
Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, Hungary, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia and Sweden.
• The following countries:
United States (except Hawaii and Alaska), Canada, Brazil, Mexico, Japan, Saudi Arabia, United Arab Emirates, Morocco, Tunisia, Algeria, Turkey, Singapore, South Korea, China, Taiwan, Norway, French Overseas Departments and Regions (except Saint-Pierre-et-Miquelon and Mayotte), Switzerland, United Kingdom
For other countries, a request can be sent to LDM DEVELOPPEMENT to obtain a quote regarding shipping costs and confirmation of the possibility of proceeding.
Please note that Food Products and Alcohol are only delivered within the European Economic Area.
The Customer can track the progress of the delivery of their order using a tracking link which is sent to them by email when the order is shipped.
6-2 Delivery Rates
Delivery charges are determined based on factors including the delivery location, weight, and/or volume of the ordered products. Packages are entrusted to a carrier independent of LDM DEVELOPPEMENT, which therefore cannot be held responsible for the service provided by the carrier.
Their exact amount is indicated to the Customer before final validation of the order and appears on the order summary as well as in the confirmation email.
6-3 Customs duties and international taxes
Products sold by LDM DÉVELOPPEMENT are shipped from France. Shipping costs include only transport and delivery to the address provided by the customer.
For deliveries outside the European Union, the Customer is informed that any customs duties, import taxes, or formalities applicable in their country of destination are their sole responsibility. These charges are not included in the price of the Products or in the delivery charges billed by LDM DÉVELOPPEMENT and must be paid directly by the Customer to the customs authorities of their country, if applicable.
In the event of refusal or non-payment of these duties and taxes by the Client, LDM DÉVELOPPEMENT cannot be held responsible for the return or destruction of goods or for any delivery delay resulting from this situation.
6-4 Delivery Methods
Products ordered on the Site can be delivered according to the following terms, depending on the options available at the time of ordering:
- Home delivery: The Products are delivered to the postal address provided by the Customer when placing their order.
- Collection point: The Customer can choose to collect their order from a partner collection point, selected during the ordering process. Information regarding the chosen collection point is communicated to the Customer by email.
- Click & Collect: The customer can collect their order directly from our Parisian store: 2 Rue de Buci, 75006, Paris, from Monday to Sunday, 10:30 am to 8 pm
The Customer is responsible for the accuracy and completeness of the information relating to the delivery address or collection point. LDM DÉVELOPPEMENT cannot be held liable for any consequences resulting from errors or omissions provided by the Customer.
6-5 Receiving the delivery
Delivery corresponds to the first actual presentation of the package to the address provided by the Customer when placing the order.
It is the Client's responsibility to unpack the received package without delay, to write any necessary reservations on the delivery note and to notify LDM DEVELOPPEMENT within 12 hours of delivery.
In the event of a particular problem concerning the delivery (damaged products), the Customer must send a registered letter with Acknowledgement of Receipt to the carrier and send a copy of it to LDM DEVELOPPMENT within 3 days following the actual delivery.
6-6 Delivery Delays
As delivery is carried out by an independent carrier, LDM DEVELOPPEMENT cannot be held responsible for any delay due to delivery conditions, since LDM DEVELOPPEMENT has made every effort on its side to meet the delivery date specified when the order was placed.
However, if delivery is more than 8 days late (excluding products ordered out of stock) compared to the date scheduled when the order was placed, the Customer will have the option to cancel their order and be refunded the amount of the order.
7. Right of withdrawal, returns and refunds
In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the products to exercise their right of withdrawal without having to provide a reason, provided that the products are returned in their original condition and complete. Return shipping costs are the responsibility of the customer.
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply:
- to products made/personalised according to the Customer's specifications (including By accepting the Site's Terms and Conditions the customer accepts that the right of withdrawal does not apply to personalized products (physical gift cards)
- to perishable products that are likely to deteriorate or expire rapidly;
- to products that have been unsealed or opened by the Customer after delivery or opened consumables (e.g. alcohol, coffee bags, boxes of chocolates, jams, etc.)
To exercise their right of withdrawal, the Customer must send an email to serviceclient@comptoirs-lesdeuxmagots.fr
Beforehand, the Customer must download and complete the withdrawal form, downloadable here , and then they must:
- Send the withdrawal form back by email
- Send photos of the product(s) in perfect condition for resale, original packaging, complete, no marks, dents, or signs of use
The customer then generates their return label and returns the package by mail.
Please note that all return shipping costs are the responsibility of the customer.
The refund will be made via the same payment method used for the order within 14 days of LDM DEVELOPPEMENT receiving the package.
Exchanges are not possible. Any product returned to LDM DEVELOPPEMENT that is incomplete, damaged, used, consumed, or soiled will not be eligible for a refund.
8. Delivery problems and delays
8-1 Non-delivery
In case of non-delivery for the following reasons:
- Incorrect or incomplete delivery address
- Failure to collect the parcel from the collection point within the allotted time
- Absence at home during delivery
The customer is responsible for non-delivery. Returning the package will trigger a full refund for the products ordered (excluding delivery charges, taxes, and customs fees). Please note that return shipping costs are entirely the customer's responsibility and will therefore be deducted from their refund.
8-2 Damaged package
If the Customer receives a damaged package, they must:
- Refuse the package upon receipt or, if necessary, provide photographic evidence that the products have been damaged within 48 hours (from the date of receipt of the package) by sending an email to customer service: serviceclient@comptoirs-lesdeuxmagots.fr
- He must then return the package by mail.
Upon receipt of the returned order, LDM DEVELOPPEMENT verifies the consistency between the condition of the returned product and the reason for the product return.
If the damage coincides with the reason for which the package was returned, the purchase can be refunded within 14 days or the damaged products can be reshipped entirely at LDM DEVELOPPEMENT's expense.
8-3 Other
In the event of:
- Missing products
- Expired products
- Different quantity delivered
The customer must provide photographic evidence within 48 hours by sending an email to customer service: serviceclient@comptoirs-lesdeuxmagots.fr
The Customer can then choose to be reimbursed for the price of the missing product(s) or choose to have the missing product(s) reshipped entirely at LDM DEVELOPPEMENT's expense.
8-4 Carrier Problems
In the event that:
- The package was delivered to the wrong person
- The package has been lost
The package was stolen.
The customer is advised to contact the carrier in charge of their package directly.
In the event that:
- The package is stuck in the warehouse or collection point without any update notification
- Package tracking is not updated

8-5 Delays
In the event that the package experiences shipping delays, the recipient will be informed directly by LDM DEVELOPPEMENT via email.
For deliveries within the European Union only:
If the package has not been delivered within 30 business days, the customer has the right to cancel their order and receive a full refund (excluding delivery charges, taxes, and any customs fees).
To exercise this right, the Customer must have their order number and tracking number ready and contact customer service by email at serviceclient@comptoirs-lesdeuxmagots.fr.
9. Guarantees
The products benefit from the legal guarantees of conformity (articles L217-4 to L217-14 of the Consumer Code) and against hidden defects (articles 1641 to 1649 of the Civil Code).
LDM DEVELOPPEMENT guarantees that the products offered for sale on its website conform to their intended use and do not have any defects or hidden flaws that make them dangerous or unsuitable for their usual use.
Products modified/repaired by the Customer, damaged during transport or due to improper use are excluded from legal guarantees.
10. Intellectual Property
All elements of the site (texts, images, graphics, logo) are protected by copyright held by LDM DEVELOPPEMENT.
Any reproduction, even partial, is prohibited without prior written authorization.
11. Personal data
Personal data is collected for order processing.
They are used by LDM DEVELOPPEMENT to ensure order tracking, delivery (processing for which the necessary personal data is communicated to the carrier), customer relationship, and requests relating to products or services offered by LDM DEVELOPPEMENT (if the Customer has expressly consented).
In accordance with the GDPR, you have the right to access, rectify, delete and transfer your data.

The personal data collected for the purposes of orders is kept for the duration of the business relationship, for the period necessary for the purpose of the processing as well as to satisfy the accounting and tax obligations of LDM DEVELOPPEMENT.
For any other details, the Client is invited to consult the privacy policy of LDM DEVELOPPEMENT.
12. Force majeure
12-1 Definition
The Client and LDM DEVELOPPEMENT cannot be held responsible for a total or partial non-performance of their obligations due to a fortuitous event or a case of force majeure which would prevent the performance of the reciprocal obligations of the parties.
For the purposes of these General Terms and Conditions of Sale, force majeure means any event beyond the control of LDM DÉVELOPPEMENT, unforeseeable, irresistible and independent of its will, which totally or partially prevents the performance of its contractual obligations.
The following are considered cases of force majeure, but this list is not exhaustive:
- Natural disasters (floods, storms, fires, earthquakes),
- War, armed conflict, acts of terrorism, riots, sabotage, civil unrest,
- General or local strikes, lockouts, pandemic/epidemic or work stoppages by staff or service providers,
- Failure of transport or postal or delivery services (including GLS or partner carriers),
- Computer or network failure or malfunction, cyberattack, or problem affecting the Shopify platform or payment systems, legal or administrative restrictions, quarantines or export or import bans.
12-2 Suspension of obligations
In the event of force majeure, LDM DÉVELOPPEMENT is exempt from its obligations for the duration of the event.
If force majeure prevents the execution of the order for an extended period, LDM DÉVELOPPEMENT will inform the Client as soon as possible and may:
- Temporarily suspend delivery of the affected Products,
Or
- Cancel the order without the Customer being able to claim damages.
12-3 Notification to the Customer
The Client will be informed as soon as possible by email or any other appropriate means of the occurrence of a force majeure event and its consequences on the execution of the order.
12-4 Effects on payments
If the order is cancelled due to a force majeure event, LDM DÉVELOPPEMENT will proceed to reimburse any sums already paid by the Client, within 14 days of the cancellation of the order.
12-5 Limitation of Liability
In the event of force majeure, LDM DÉVELOPPEMENT cannot be held responsible for delays, interruptions, damages or losses suffered by the Client or third parties related to the impossibility of executing the order.
13. Entirety of the contract
These General Terms and Conditions of Sale, the General Terms and Conditions of Use of the Site and the order summary sent to the Customer form a single contractual whole and constitute the entirety of the contractual relations between LDM DÉVELOPPEMENT and the Customer.
It is expressly agreed that electronic exchanges between the Parties, including emails and automatic recording systems used on the Site, shall be considered authentic as to the nature, content and date of orders placed by the Customer.
The Customer may, in accordance with applicable legal provisions, access the electronic contract concluded with LDM DÉVELOPPEMENT. To do so, they must contact Customer Service by email, specifying all the information necessary to identify their order, including the order number and their contact details.
14. Applicable Law – Disputes
This contract, and all orders related to it, is governed by French law.
In the event of a dispute relating to the execution or interpretation of these General Terms and Conditions of Sale, the Customer has several options:

- In the absence of an amicable resolution, the Client may, if he wishes, also resort free of charge to a consumer mediator in order to try to resolve the dispute amicably.

In the absence of an amicable settlement, any dispute relating to the validity, interpretation or execution of these General Terms and Conditions of Sale shall be submitted to the competent Judicial Court of Paris, including in the event of multiple parties, summary proceedings or expert assessment, subject to the mandatory provisions of the Code of Civil Procedure.
In the event of a dispute, an amicable solution will be sought first.
In the absence of an amicable resolution, the client may resort to a mediator or take the matter to the competent court.
